Exercise Participation & Assumption of Risk Agreement

Effective 1 September 2026

This Agreement forms part of your Body Matrix Membership and should be read together with the Membership Agreement, Club Rules & Policies, and Privacy Policy.

By signing below, you confirm that you have read and understood this Agreement.

1. Voluntary Participation

I acknowledge that I have chosen to participate voluntarily in exercise, coaching and recreational fitness activities provided by Body Matrix.

These activities may include, but are not limited to:

  • resistance and weight training

  • machine-based exercise

  • cardiovascular exercise

  • "No Hit" boxing and bag work

  • mobility and flexibility training

  • functional training

  • group fitness classes

  • personal training

  • exercise assessments

  • stretching and recovery sessions

  • online coaching and exercise programming

  • educational workshops and fitness events

2. Acknowledgement of Inherent Risks

I understand that exercise and recreational fitness activities involve inherent risks that cannot be completely eliminated, even when reasonable care is taken.

These risks may include:

  • muscle soreness

  • strains and sprains

  • falls

  • slips

  • fractures

  • equipment failure despite reasonable maintenance

  • dizziness

  • dehydration

  • aggravation of existing injuries

  • cardiovascular events

  • serious injury

  • permanent disability

  • death

I understand that these risks may arise from my own actions, the actions of other participants, environmental conditions, or other factors inherent in recreational exercise.

3. My Health

I confirm that, to the best of my knowledge:

I am physically able to participate in exercise suitable for my condition.

I have disclosed any medical condition, injury, illness or limitation that may affect my ability to exercise safely.

I will immediately notify Body Matrix if my health changes in a way that may affect my participation.

I will seek medical advice before participating if I have any concerns about my health.

If I feel unwell, dizzy, faint or unsafe while exercising, I will stop immediately and notify a member of staff.

4. My Responsibilities

While using facilities at Body Matrix, I agree to:

follow all reasonable directions given by staff;

use equipment safely and only for its intended purpose;

exercise within my own ability;

comply with the Membership Agreement and Club Rules;

respect the safety and privacy of other members;

report hazards, damaged equipment or injuries as soon as reasonably practicable; and

not participate while affected by alcohol, illegal drugs or any condition that may place myself or others at unreasonable risk.

I understand that failure to follow these responsibilities may increase my risk of injury.

5. Assumption of Risk

I acknowledge that I understand the nature of the activities offered by Body Matrix and voluntarily accept the inherent risks associated with participating in those recreational activities.

To the extent permitted by law, I accept responsibility for injury, illness, loss or damage arising from those inherent risks.

Nothing in this Agreement excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.

6. Australian Consumer Law

I acknowledge that Body Matrix supplies recreational services.

I understand that, to the extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth) and other applicable laws, Body Matrix may rely on this Agreement in relation to liability arising from the supply of recreational services.

I also understand that this Agreement does not exclude liability where Australian law does not permit liability to be excluded, including liability that cannot lawfully be limited or excluded.

7. Results

I understand that:

participation in exercise does not guarantee weight loss, muscle gain or any other specific result;

individual outcomes vary; my results depend on many factors including attendance, effort, nutrition, recovery, sleep, client communication, medical conditions and lifestyle.

No guarantee has been made regarding my individual results.

8. Personal Property

I understand that I am responsible for my personal belongings while attending Body Matrix.

I should use lockers where available and avoid bringing unnecessary valuables into the facility.

9. Emergency Medical Assistance

If Body Matrix staff reasonably believe that I require urgent medical attention, I authorise them to contact emergency services and, where appropriate, my nominated emergency contact.

I understand that any medical treatment or transport costs remain my responsibility unless otherwise required by law.

10. Photography & Video

I understand that Body Matrix operates CCTV for safety and security.

I also understand that members may not photograph, film or record other members or staff without their consent and the approval of Body Matrix management.

11. Changes to this Agreement

Body Matrix may update this Agreement where reasonably necessary to reflect changes in:

  • legislation;

  • safety requirements;

  • industry practice; or

  • the services provided.

  • Where a change materially affects members' rights or obligations, reasonable notice will be provided before the updated version takes effect.
